Zero Tolerance Policy
We provide a software service with mFUSION that allows companies to deliver permission-based communications to their prospects and customers. We therefore prohibit sending unsolicited SMS through our system.
We consider SMS unsolicited if the recipient has not given clear, explicit permission to the sender to receive email from that sender. Thus, we prohibit our clients from using traded or appended lists. All of our customers are required to comply with this policy. If we discover clients are sending unsolicited email, they are terminated from our service.
Our Agreement
Since our inception in 2002 and before the introduction of any anti-spam legislation, we have always had a zero tolerance policy to unsolicited SMS messages (spam). We require that all clients certify that they will only use the mFUSION service to send SMS messages to customers and prospects that have explicitly consented (opted-in) to receive SMS messages from them.
If we determine that a client is using mFUSION for spam, we will terminate their service immediately. Our clients may not use misleading, false, or deceptive subject lines for their services.

Zero Tolerance Definition
Zero Tolerance means and Immediate block of services and immediate ban. We define any unwanted text (SMS) message as spam. If the recipient of the text message is receiving an undesired message we consider this as spam.
Guidelines
We follow the Mobile Marketing Association (MMA) and wireless carrier’s guidelines regarding the procedures that protect users from unwanted text (SMS) messages.
Unsubscribe/Opt-Out Procedure
Any text message (SMS) recipient can, at anytime, opt-out permanently from receiving future messages from that sender by simply sending a text message from their mobile phone to our short code with any of the following words END, STOP, STOP ALL, QUIT, CANCEL, or UNSUBSCRIBE.

Disruptions and Damages
Misuse
If the client causes damages or disruptions of the website or our delivery system by bad intent, he/she becomes liable for all direct and indirect consequences and associated costs.
Message Content
The client assumes full responsibility for the content of the messages transmitted by herself or by a third party on her request. The client agrees to abide to all laws and regulations applicable to the content and intent of the messages transmitted by her. The client assumes liability for all consequences and costs arising out of offences against such regulations. The client must ensure that her message delivery does not cause disturbance or harassment of a recipient or other third party. The client agrees to refrain from sending messages containing offensive, violent, pornographic, or discriminatory, or otherwise illegal content. The client is not permitted to send messages to recipients who have made clear that they do not wish to receive these messages or advertisements.

See: http://www.mfusion.com/privacy_policy The client acknowledges that message content is transmitted unencrypted and that eavesdropping of phone communications, including SMS delivery, by third parties is possible.
Delivery
The client acknowledges that we deliver messages via major telecommunications companies and mobile network providers and can therefore only influence the delivery of the messages within the technical constraints imposed by the above mentioned providers.
Messages submitted via our website will be transferred to the addressed recipients within seconds or minutes, provided that the recipient's receiver is switched on and located in an area covered by her subscribed network provider. The client acknowledges that, depending on the recipient's provider service, it may not be possible to transmit the message to the recipient successfully, particularly if the provider does not support chosen delivery method at all.
The Client shall be liable for and shall indemnify from and against any damage, including indirect or consequential damage, for inadequate End User protection (including but not limited to spam, phishing, and fraud) and legal violations that result from the End User Service, the Client’s improper use of the Services, the Client’s instructions, or other fault of the Client or its agents or contractors.
Checks and Measures for Customer Protection
When using mFUSION we have multiple ways to track and keep service providers 'compliant':
- Regulator Approval - All services must be regulator approved before we allow services.
- We manually screen clients periodically and randomly to check for anomalies in the campaigns.
- We have internal systems to check for spam based on our own algorithms.
- We background check all companies using our software (we accept no individuals only companies).
- We check all client promotions pre live.
- We check all client promotions periodically and randomly.
- We have internal systems to capture any bursts of messages that contain certain words or phrases.
- We have fraud detection algorithms and software to detect any misuse of services.
- We check and screen the content of the campaigns before and during the service.
Customer Care
Our Account Managers, assigned on using our services will explain these terms of service as part of our aim to maintain our standards in Zero Tolerance and consumer protection. We have a dedicated Customer care team to deal with all enquires and all messaging and promotions must display our customer care phone numbers.
